Privacy policy

Introduction 

New Medical Centre (NMC) was established in the year 2007, with a mission to provide quality medical care in a timely fashion to children and families of Georgia. NMC is dedicated to conducting business in accordance with Data Protection laws and related regulations, as well as the regulators or court's decision to determine what constitutes legality, and in line with the highest standards of commercial and ethical conduct.

This Privacy Policy (“Privacy Policy”) describes what information New Medical Center {herein after referred to as  “NMC” or “Platform”}, as the owner of the Platform may collect from a user (“You”, “Your” or “User”), on or through Our website/Platform (https://www.nmctifton.com/) (the “Site”) or one or more mobile application (the “App”), directly (the owner and the operator of the Platform are referred collectively as “We”/ “Us”/ ”Our”) or in relation to services otherwise rendered by Us (collectively “Platform”), and how We use, process, disclose and try to protect such information.

By using Our Platform, or the Services, You confirm that You have read, understood, and agree with the privacy practices described in this Privacy Policy, and the Terms and Conditions (the “Terms”) and the collection, storage and processing of Your information in accordance with them. This Privacy Policy shall go in consonance with the Terms and Conditions of Our Platform (separate documents) and if you are accepting the terms of this Privacy Policy, your acceptance to the same shall provide an implied acceptance to the Terms and Conditions of the Platform.

This policy outlines specifically what is expected of NMC employees and other parties in terms of the collecting, using, retaining, transferring, disclosing, and destroying of a data subject's personal information. The leadership of NMC has further pledged to ensure the ongoing and successful application of this policy, and it anticipates that all of its employees and third parties will share in this commitment. It goes without saying that NMC has zero tolerance for any violation of this policy, and any instance of violation will be dealt with severely, with disciplinary action or business sanctions. By providing your explicit consent and/ or by your provision of information to us, you acknowledge the terms of this policy and the use and disclosure of your personal data as set out in this policy.

 

Definition

Personal Data: 

Any information connected to an identified or identifiable natural person. A person is identifiable when he/she may be identified directly or indirectly, in particular by an identification number or by any physical, physiological, psychological, economic, cultural, or social features specific to this person.

Special category data: 

Data connected to a person's racial or ethnic origin, political views, religious or philosophical beliefs, membership of professional organisations, state of health, sexual life, criminal history, administrative detention, putting a person under restraint, plea bargains, abatement, recognition as a victim of crime or as a person affected, also biometric and genetic data that allow to identify a natural person by the above features. 

Biometric data: 

Any physical, mental, or behavioural feature which is unique and constant for each natural person and which can be used to identify this person (fingerprints, footprints, iris, retina (retinal image), facial features). 

Genetic data: 

Unique and constant data of a data subject relating to genetic inheritance and/or DNA code that makes it possible to identify them.

Protected health information

Protected health information under the U.S. law is any information about health status, provision of health care, or payment for health care that is created or collected by an entity, and can be linked to a specific individual.  The HIPAA Privacy Rule provides federal protections for personal health information held by covered entities and gives patients an array of rights with respect to that information.

 

Scope

This privacy policy applies to information collected through any websites, mobile applications, and/or online or mobile-enabled technology, and/or digital tools that display or link to this privacy statement (collectively, our “Online Platforms”). This privacy policy also applies to information shared with us by our approved partners and other third-party sources.

This privacy policy does not apply to (i) information collected from you either offline or through websites and other online services that do not display or link to this privacy statement, including third-party websites to which our online services may link, or (ii) information that would be considered “Protected Health Information” under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). NMC’s use and disclosure of Protected Health Information is set forth in the NMC Data Protection Notice for Patients (link).

Depending on your relationship to NMC, we may collect the following categories of information:

  • Identifiers, such as your name, contact information, and online identifiers.

  • Professional information and educational information, such as information about your medical specialty.

  • Demographic information, such as gender and marital status.

  • Medical, health, and biometric information, such as medical condition and biological characteristics.

  • Internet and electronic network activity information, such as your IP address and information about your interaction with our online Services.

  • Geolocation information.

  • Audio, electronic, and visual information, such as identifiable photographs and video.

  • Correspondence you send to us.

When you view and/or interact with our Online Platforms, we may collect and combine information about you, how you engage with our Online Platforms and the devices you use to view and/or interact with our Online Platforms for the legitimate purposes described below. This includes information you provide to us in connection with your use of the Online Platforms and information collected automatically when you view and/or interact with our Online Platforms.

Some of the information we collect may be personally identifiable information, which includes, but is not limited to, information like your name, email address, postal address, or phone number. We do not collect information that would personally identify you unless you choose to provide it or as otherwise provided in this privacy statement. You can access and browse our Online Platforms at any time without providing any personally identifying information. 

 

Information You Provide to Us

We collect information you provide directly to us, such as when you create or modify your account or user preferences, sign up for a newsletter, contact us, respond to a survey, or otherwise communicate with us. This information may include your name, email address, phone number, postal address, insurance information, personal health information (however this does not rise to the level of “Protected Health Information” protected by HIPAA), survey responses, user content stored or entered into the forms found in our Online Platforms, and other information you choose to provide through use of our Online Platforms.

(i) set up your account (if applicable);

(ii) if you elect to receive information from NMC, provide you with such information;

(iii) improve the Online Platforms;

(v) facilitate your job or student application; and/or

We will not use the information you provide for any purposes other than as described in this privacy statement or explained to you at the point at which the information was collected.

 

Information Collected Automatically

We may automatically collect additional information about your visit to our Online Platforms, including pages you visit, your geographic location based solely on your Internet Protocol (IP) address, promotions with which you interacted, and other behaviors. This information is collected for the purpose of improving your overall visit to our Online Platforms by providing interest-based content. For example, we may collect information about your geographic location and a specific interest, based on topics you have browsed on our Online Platforms, so that we can highlight a program or resource close to your location. When interacting with our services within social media, we may obtain information stored within social media or authorized by you to be collected by us within such social media. We may also use certain third-party products or services (“Third-Party Tools”), such as Google Analytics, a web analysis service provided by Google, in order to better understand the use of our Online Platforms. These Third-Party Tools may collect information such as how often users visit our Online Platforms, what pages they visit, and the websites which referred you to our Online Platforms. Further, the Third-Party Tools may use the data collected to track and examine the use of the Online Platforms, to prepare reports on its activities, and to share them with other related services. How Do We Collect Information?

We obtain information directly from you in a variety of ways, such as when you use our Services and provide information to us electronically, over the phone, by other means, or by giving others permission to do so on your behalf.

NMC, its parents, and affiliates are not responsible for the privacy and security of email messages except those stored in our system.

Occasionally, at our discretion, we may include or offer third-party products or services on or linked to our Online Platforms. These third-party websites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked websites. Nonetheless, we seek to protect the integrity of our website and welcome any feedback about these websites. We also encourage the following disclaimer when links are provided: “You are being redirected to a website outside of NMC. NMC is not responsible for any aspect of the external website.”

COPPA (Children’s Online Privacy Protection Act)

We do not knowingly collect or use any personally identifiable information from children (defined by COPPA as minors younger than 13) on our Online Platforms. We do not knowingly allow children to communicate with us or use any of our Online Platforms. If you are a parent and become aware that your child has provided us with information, please contact us using one of the methods specified herein, and we will work with you to address this issue.

 

California and Delaware “Do Not Track” Disclosures

California and Delaware law require us to indicate whether we honor “Do Not Track” settings in your Web browser concerning targeted advertising. At this time, there is no worldwide uniform or consistent industry standard or definition for responding to, processing, or communicating “Do Not Track” signals. Thus, like many other websites and online services, we do not currently respond to any “Do Not Track” browser requests.

 

California Privacy Rights

Under California law, California residents have the right to request in writing from businesses with whom they have an established business relationship: (a) a list of the categories of personally identifiable information—such as name, email, and mailing address, and the type of services provided to the customer—that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes; and (b) the name and address of all such third parties. Please note that we are only required to respond to each customer once per calendar year.

 

Job Applicants and Contractors

The information you provide in your job application and that we otherwise gather in evaluating your application will be used for recruitment and other customary human resources purposes, including any necessary government reporting and recordkeeping obligations, if you have applied for employment or a contract position with NMC. If relevant, this information can also include a criminal history check and a federal exclusion list status.

 

Children

We do not knowingly collect or sell any information from children, as defined by applicable law, without parental consent or as otherwise permitted by applicable law. 

 

Security

To prevent the loss, abuse, or alteration of the information under our control, this site has security measures in place. When entering sensitive data on order forms on our site, we use appropriate technology to encrypt the transmission of that data. 

In some cases, we might also provide third parties access to information about you so they can perform services for us, such processing credit card payments. Only the information required by the third party to carry out the requested service will be disclosed about you. Your personally identifiable information cannot be kept, shared, purchased, sold, stored, or used for any other reasons by these businesses.

 

We adhere to recognised standards to safeguard submitted personal information both during transmission and after receipt. However, no technique of electronic storage or communication over the Internet is 100 percent (100%) secure. Consequently, we are unable to ensure its complete security.

Employees of a MNC who are involved in data processing will not work beyond the scope of the powers conferred upon them. Employees must be bound to protect confidentiality of the personal data, including after termination of their official duties.

 

Transfer of Data Abroad 

If you are visiting this Site from a country other than the country in which our servers are located, your communications with us may result in the transfer of information across international boundaries. By visiting this Site and communicating electronically with us, you consent to such transfers.

We may change this Privacy Policy from time to time and reserve the right to do so any time. This Policy is effective as of 5th of August and was last updated on 18th August 2022.
